2.1.3. Administration of the Online Store Website means authorized employees for the management of the Website acting on behalf of OlympiT.
2.1.4. User of the Web site of the online store (hereinafter referred to as "User") - a person who has access to the Site, via the Internet and uses the Site.
2.1.5 The content of the Web site of the Online Store (hereinafter referred to as the Content) is the protected results of intellectual activity, including the texts of literary works, their titles, prefaces, annotations, articles, illustrations, covers, musical works with or without text, graphic, textual, photographic, derivative, composite and other works, user interfaces, visual interfaces, brand names, logos, computer programs, databases, as well as the design, structure, selection, coordination, appearance, general style and design of the Web site of the Online Store (hereinafter referred to as the Content).
3. SUBJECT OF THE AGREEMENT
3.1 The subject of this Agreement is to provide the User of the Online Store with access to the Goods and services contained on the Website.
3.1.1 The Online Store provides the User with the following types of services (services):
access to electronic content on a paid basis, with the right to purchase (download), view content;
access to search and navigation in the online store;
providing the User with an opportunity to post messages, comments, feedback from Users, evaluate the content of the Online Store;

3.1.2 This Agreement applies to all existing (actually functioning) services (services) of the Online Store, as well as to any subsequent modifications and additional services (services) of the Online Store.

The change of the fee will not apply to Users who have been registered at the time of the change of the fee, except in cases specifically agreed by the Administration of the Website of the Online Store.
4.2 The User has the right:
4.2.1. To access the Site after completing the registration requirements.

4.3 The Site User undertakes to:

4.3.2 Respect the property and non-property rights of authors and other right holders when using the Site.
4.3.3 Do not take actions that may be regarded as a violation of the normal operation of the Site.
4.3.4 Not to distribute confidential and protected information about individuals and legal entities through the Site.
4.3.5 Avoid any actions that may violate the confidentiality of information.
4.3.6. Not to use the Site for distribution of information of advertising nature, except with the consent of the Site Administration.
4.3.7. Not to use the services of the Website of the Online Store for:

Download content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, national, gender, religious, social grounds; contains inaccurate information and (or) insults directed to specific individuals, organizations, authorities.

4.4 The User is prohibited to:
4.4.1 Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of the Site of this Online Store;
4.4.2 Disrupt the normal operation of the Site;
4.4.3. Bypass the navigation structure of the Site in any way in order to obtain or attempt to obtain any information, documents or materials by any means not specifically represented by the services of this Site;
4.4.4 Unauthorized access to the functions of the Site, any other systems or networks associated with this Site, and any services offered on the Site;

5.3 The content of the Website is protected by copyright, trademark law, as well as other rights related to intellectual property and legislation on unfair competition.

5.5 The User is personally responsible for maintaining the confidentiality of the account information, including the password, as well as for all actions performed on behalf of the User account.
5.6 The User shall immediately notify the Site Administration of any unauthorized use of his/her account or password, as well as any other breach of security.
5.7 The Site Administration has the right to unilaterally cancel the User's account if it has not been used for more than 12 consecutive calendar months without notice to the User.
5.7 This Agreement applies to all additional terms and conditions related to the purchase of Goods and services provided on the Site.
5.8 The information posted on the Site may not be interpreted as a change in the terms and conditions of the Agreement.
5.9. The Website Administration shall have the right to make changes to the list of Goods and Services offered on the Website and (or) to the prices applied to such Goods when selling them, and (or) to the services provided by the Online Store at any time without notice to the User.
5.10. The documents specified in clauses 5.10.1 - 5.10.4 of this Agreement shall govern in relevant part and apply to the User's use of the Website. The following documents are included in this Agreement:

5.10.3. Order Application;
5.10.4. Suggestions and comments.
5.11. Any of the documents listed in clause 5.10. of this Agreement may be updated. Changes come into effect from the moment of their publication on the Website.
6. LIABILITY
6.1 Any losses that the User may incur in case of intentional or negligent violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another User, shall not be compensated by the Site Administration.
6.2 The Site Administration shall not be liable for:
6.2.1 Delays or interruptions in the transaction caused by force majeure, as well as any cases of failures in telecommunication, computer, electrical and other related systems.
6.2.2 Operation of transfer systems, banks, payment systems and delays related to their operation.
6.2.3 Proper functioning of the Website, if the User does not have the necessary technical means for its use, as well as the absence of the obligation to provide Users with such means.
7. VIOLATION OF THE TERMS OF THE USER AGREEMENT
7.1 The Site Administration has the right to disclose any information collected about the User of the Site, if the disclosure is necessary in connection with an investigation or complaint about the misuse of the Site or to establish (identify) the User who may violate or interfere with the rights of the Site Administration or other Users of the Site.
7.2. The Site Administration has the right to disclose any information about the User, which it deems necessary to fulfill the provisions of the current legislation or court decisions, to ensure fulfillment of the terms of this Agreement, to protect the rights or safety of OlympIT, Users.
7.3 Administration of the site has the right to disclose information about the User, if the current legislation of the Russian Federation requires or authorizes such disclosure.
7.4. The site administration has the right to terminate and (or) block access to the Site without prior notice to the User, if the User has violated this Agreement or the terms of use of the Site contained in other documents, as well as in the event of the termination of the Site or due to a technical failure or problem.
7.5 The Site Administration shall not be liable to the User or third parties for termination of access to the Site in case of violation by the User of any provision of this Agreement or any other document containing the terms of use of the Site.
8. DISPUTE SETTLEMENT
8.1. In case of any disagreements or disputes between the Parties to this Agreement, before appealing to the court, a claim (a written proposal for voluntary dispute settlement) shall be mandatory.
8.2 The recipient of the claim within 30 calendar days from the moment of its receipt shall notify the claimant in writing of the results of consideration of the claim.
8.3 If the dispute cannot be settled voluntarily, either Party shall have the right to apply to the court for protection of its rights granted to it by the applicable law
8.4 Any claim in respect of the terms of use of the Website shall be filed within 1 month from the moment of occurrence of the basis for the claim, except for the protection of copyrights for the legally protected materials of the Website. In case of violation of the provisions of this clause, any claim or cause of action shall be null and void.
9. ADDITIONAL CONDITIONS
9.1 The Administration of the Site does not accept from the User counter-proposals to change this User Agreement.
9.2 User feedback posted on the Site is not confidential information and can be used by the Site Administration without restrictions.
